2. On the channel International RCTV and the request of inscription like service of audio-visual national production, CONATEL points out that (i) on January 21, 2010 CONATEL considered International RCTV to be SPNA (ii) there was requested the inscription of this channel like SPNA on February 22, 2010 and (iii) hence passed more than 15 working days with the procedure paralyzed by causes attributable to RCTV International Corp, for which there occurs the waiver of the request of inscription of this channel like SPNA, based on the article 32 of the Organic Law of Telecommunications.
3. The CONATEL arguments on this waiver are absolutely illegal for the following reasons:
a) So that it produces a waiver for paralyzation of a procedure, it is necessary that the Administration notifies previously the interested party that the procedure is paralyzed. The waiver does not operate of right plenary meeting but it needs that the Administration does a WARNING to the interested party, after which they begin to cover these 15 working days to which there alludes the article 32 of the Organic Law of Telecommunications. IN EAST I MARRY, THERE WAS NEVER A PREPARATION OF A SUPPOSED PARALYZATION OF ANY PROCEDURE.
b) In this case, the procedure began with the request presented by RCTV International Corp, on February 22, 2010. Hence, for today only 9 working days had passed from the presentation of the request.
c) In the useless and absolutely untenable and illegal assumption that CONATEL insists that there existed a procedure opened on request of RCTV International Corp., that International Corp paralyzed on January 21, 2010 for more than 15 working days through the fault of RCTV., CONATEL must have NOTIFIED to RCTV International Corp., that this procedure was paralyzed and only from there counting 15 working days to apply the waiver that they allege. Also, on February 8, 2010, RCTV International Corp., it had presented a request of review of office of the decision of Conatel of January 21, 2010, with which there would have stayed active this SUPPOSED procedure which existence alleges CONATEL.
d) It is a question of an interpretation of the institution of the tacit waiver for paralyzation of the administrative procedure that not only is absolutely illegal but it does not have any jurisprudential or doctrinal precedent who supports it.
3. With regard to the channel RCTV World, RCTV International Corp., without the Organic Law of Telecommunications or the applicable regulations it being demanded by them, it presenting entirely the detail of his future programming to CONATEL. It is absolutely false that has not detailed the nature of his programming. Hence, CONATEL lies absolutely in this sense.

It pointed out that, in contrast to what he says the regulatory company, the international channels do not need previous authorization. “It does not need. HBO, Discovery or TNT, none of those needs Conatel authorization” he said.
